Why didn't they plead insanity with this guy?

Apparently a crazy Larry Bird fan had his prison sentence increased to match Bird's jersey number, 33. The only rational explanation I can come up with on this is that the defense team is planning an appeal and they are using this as evidence that their client is insane. At least his favorite player isn't Ron Artest (jersey number 91). I'm sure the victim and his family love that this lowlife is getting publicity.
